ISSUES APPLICANT MUST ADDRESS:  On April 29, 2019, the trademark examining attorney and Pradip Jain discussed the issues below.  Applicant must timely respond to these issues.  See 15 U.S.C. §1062(b); 37 C.F.R. §2.62(a); TMEP §§708, 711.

 

Additional Fee Required

 

Applicant must submit an additional processing fee of $125 per class because the application as filed did not meet the TEAS Plus application filing requirements.  See 37 C.F.R. §§2.6(a)(1)(v), 2.22(a), (c); TMEP §§819.01 et seq., 819.04.  Specifically, applicant failed to meet the following application filing requirement:  a translation of all non-English wording in the mark was not provided. 

 

The additional fee is required even if applicant later corrects these application requirements.

 

 

 

EXAMINER’S AMENDMENT

 

APPLICATION HAS BEEN AMENDED:  In accordance with the authorization granted by the individual identified in the Priority Action section above, the trademark examining attorney has amended the application as indicated below.  Please advise the undersigned immediately of any objections.  TMEP §707.  Any amendments to the identification of goods and/or services may clarify or limit the goods and/or services, but may not add to or broaden the scope of the goods and/or services.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.

 

Identification of Goods

The identification of goods is amended to read as follows:  “Gold jewelry; gold jewellery, made with diamonds, precious and semi-precious stones, and man-made stones; gold watches and timepieces”.  See TMEP §§1402.01, 1402.01(e).

 

Supplemental Register

The application is amended to the Supplemental Register.  See 15 U.S.C. §1091; 37 C.F.R. §§2.47, 2.75; TMEP §§815.02, 816.01.

 

Deletion of Disclaimer

Applicant has authorized the withdrawal of applicant’s voluntary disclaimer of “ORO AND ITALIA”.  The disclaimer is hereby deleted from the application.  See 15 U.S.C. §1056(a); TMEP §1213.01(c).
